Ripple case: SEC appeal unlikely as it gains from 'current confusion' — Haun Ventures CEO

A former federal prosecutor turned chief executive of a crypto-focused venture capital fund says she would be “surprised” if the United States securities regulator lodges an immediate appeal against the Ripple case ruling, as it currently benefits from lack of “legal clarity.”

On July 13, Judge Torres granted a partial summary judgment in favor of Ripple Labs regarding XRP’s status as a security. At the time, a few commentators warned that an appeal from the SEC would be a possibility.

However, in a July 15 Twitter thread, Haun Ventures CEO Katie Haun explained that the securities regulator will likely stay quiet as it benefits from the “current confusion” and that losing an appeal could jeopardize its future enforcement actions.

“Anything is possible, but an immediate appeal seems unlikely both because the agency would have to ask the court to split this decision from the portion going to trial and because I’m skeptical the SEC actually wants legal clarity,” said Haun.

“The Commission benefits from the current confusion and losing these issues on appeal would jeopardize its entire enforcement agenda. So I’d be surprised if the SEC tried to appeal now.”

Bitcoin price support at $30K opens the door for gains from UNI, ARB, AAVE and MKR

Bitcoin (BTC) attempted to break away from its boring sideways price action on July 13 following Ripple’s legal victory over the United States Securities and Exchange Commission, but the enthusiasm proved to be short-lived. Sellers pulled the price back into the range on July 14, indicating that they remain active at higher levels. However, a positive sign is that the bulls have kept Bitcoin’s price above $30,000.

Market observers are expected to closely follow the review process for the various exchange-traded fund (ETF) proposals for a spot Bitcoin ETF, prominent being the proposal by BlackRock. Interestingly, out of 550 ETF applications by BlackRock, only one has been rejected, according to Bloomberg Intelligence’s Eric Balchunas and James Seyffart.

Judge rules XRP is not a security in SEC’s case against Ripple

Ripple Labs scored a victory in a district court in New York on July 13, with Judge Analisa Torres ruling partially in favor of the company in a case brought forth by the U.S. Securities and Exchange Commission (SEC) dating back to 2020. According to court documents, Judge Torres granted summary judgment in favor of Ripple Labs, ruling that the XRP token is not a security, but only in regard to programmatic sales on digital asset exchanges. XRP’s price skyrocketed within minutes of the news breaking. The case has been ongoing since December 2020, when the SEC sued Ripple and two of its executives over allegations of offering an unregistered security. Despite the positive outcome, several lawyers warned against celebrating too soon, noting the ruling is only partial and does not set a precedent. In addition, the SEC may appeal the decision, which could result in a reversal by a higher court.

XRP becomes 4th largest crypto after Ripple’s partial win over SEC

XRP has become the fourth-largest cryptocurrency by market capitalization this week after Ripple’s partial victory over the SEC. The price of XRP surged as much as 98% in the hours following the decision, reaching as high as $0.93, according to data from TradingView. Meanwhile, its market cap surged a whopping $21.2 billion to reach a new yearly high of $46.1 billion. The new ruling has also sparked a fresh wave of re-listing activity from mainstay U.S. exchanges, with Coinbase, Kraken and iTrustCapital making the token available for trading on their respective platforms.

Celsius Network fined $4.7B by FTC, and CEO arrested under criminal fraud charges

U.S. authorities have announced charges against the former CEO of bankrupt crypto lender Celsius, Alex Mashinsky, over securities fraud, commodities fraud and wire fraud. Former chief revenue officer Roni Cohen-Pavon and Mashinsky will also face charges of conspiracy, securities fraud, market manipulation and wire fraud related to manipulating the price of the Celsius token. Authorities arrested Mashinsky as part of the indictment, which includes seven criminal counts. In parallel, the Commodity Futures Trading Commission announced a complaint against Celsius along with a $4.7 billion fine, claiming its co-founders marketed the platform as a “safe place” for consumers to deposit their cryptocurrency while misappropriating over $4 billion in consumers’ assets. Under similar allegations, the SEC also filed a lawsuit against the company. While Celsius is cooperating with regulators, Mashinsky pleaded not guilty to charges of misleading customers and inflating the CEL token.

Europe’s first spot Bitcoin ETF eyes 2023 debut after year-long delay

Europe’s first spot Bitcoin exchange-traded fund (ETF) is set to debut later this year after a long delay. The Bitcoin ETF, created by London-based Jacobi Asset Management, was set to debut in July 2022 but was postponed due to market conditions. The asset manager now sees a gradual shift in demand compared with 2022. A related development also took place in Argentina this week, as the nation welcomed its first Bitcoin futures contract. According to Matba Rofex, the trading platform behind the investment vehicle, it is the first Bitcoin futures contract in Latin America.

Binance has reportedly laid off hundreds of employees in recent weeks. According to former employees, cuts were global and customer service workers were heavily affected, particularly in India. Including this week’s layoffs, over 1,000 employees have lost their jobs at the exchange. Before the slash, Binance’s global headcount was estimated at 8,000. The reorganization could cost Binance more than a third of its staff. The crypto exchange announced the 20% reduction in staff on May 31, claiming it was not downsizing but reallocating resources amid the ongoing crackdown in the United States. Binance’s most enduring challenge is reportedly an ongoing investigation of its activities and executives by the U.S. Justice Department.

Solana price hits a 2023 high, but do strong fundamentals back the SOL rally?

Solana (SOL) price briefly surged to a new year-to-date peak on June 14 after Ripple’s partial win against the U.S. Securities Exchange and Commission in the case contesting XRP’s position as a security. 

The token recorded gains of 48.09%, reaching a peak of $32.40 as news of the court ruling spread, before retracing below the $30.00 level.

The positive gains following the verdict not only eliminated the losses from June 2023 when the SEC considered SOL a security in its lawsuit against Binance and Coinbase, but also reclaimed levels not seen since the FTX collapse in November 2022.

However, the network's usage and market charts suggest that a long-term bullish price trend is unlikely, with the $30 level forming a crucial resistance level.

Solana ecosystem growth stalls

The total fees paid on Solana are still ranging below Q3 2022 levels, per Token Terminal data, referring to a time before the FTX collapse, suggesting that the network’s activity has failed to revive completely.

BTC liquidates $50 million shorts in new squeeze

Data from Cointelegraph Markets Pro and TradingView showed BTC price movements returning to cement support after rapid gains the day prior.

Already tipped for a trip higher, Bitcoin reacted instantly to news that a United States judge had supported the idea that altcoin XRP (XRPwas not a security.

This was taken by markets as a blow to regulator the Securities and Exchange Commission (SEC), which in recent months had sought to label altcoins as securities en masse.

XRP/USD immediately spiked by over 100%, almost touching the $1 mark before returning to trade near $0.80 at the time of writing. The last time that such levels formed part of the chart was in April 2022.

Ripple CTO warns against XRP scams amid SEC-induced hype

A court ruling in favor of Ripple Labs — stating that XRP (XRP) is not a security — reignited the long-lost hype around the ecosystem. Anticipating an influx of scams as the token rallies defying bearish sentiments, Ripple CTO David Schwartz issued a warning to investors.

A two-year-long legal battle between the Securities and Exchange Commission (SEC) and Ripple partly concluded on July 13 with XRP having ripped off the ‘securities’ label by the United States District Court in the Southern District of New York.

What followed was an organic but substantial spike in XRP’s market price. As shown below, the XRP price rallied over 70% — bringing up its value from $0.47 to $0.82 in a day. The incident also marks the biggest price jump XRP witnessed over the past year.

The hype around cryptocurrencies or crypto ecosystems like nonfungible tokens (NFTs) is when crypto scammers get highly active in trying to dupe unwary investors. Schwartz took to Twitter to warn against the rising XRP scams. He said:

The court ruling determined that XRP holders do not have a reasonable expectation of earning profits from the efforts of others. This outcome represents a positive development for the entire cryptocurrency industry.

‘Altcoin season’ anyone? Bitcoin dominance tumbles after XRP victory

Bitcoin (BTC) dominance has taken a tumble in the wake of Ripple’s partial victory against the United States Securities and Exchange Commission, with a surge in altcoin prices briefly causing BTC dominance to fall under the 50% mark. 

Bitcoin dominance — the measure of how much Bitcoin makes up of the total crypto market cap — fell to 49.76% during Asian trading on July 14, according to Tradingview.

Just weeks earlier, BTC market dominance finally managed to rachet above 50%  after a dry spell of two years, amid a slew of applications for spot Bitcoin ETFs from major financial firms. Over the last 24 days, Bitcoin dominance had been hovering around 51% and 52%.

The recent dip in Bitcoin dominance comes as the crypto community is chanting the return of “altcoin season.”

Boosted by Ripple’s court victory the XRP token skyrocketed 83% to top out at an intraday high of $0.866, and briefly became the fourth-largest crypto asset by market capitalization. It is currently sitting at 5th place after a tussle with Binance Coin (BNB).

In a landmark ruling on July 13, Judge Torres determined that XRP (XRP) is not a security — at least when sold to the general public.

The decision was met with a joyous uproar from XRP token holders and came with a massive surge in the token's price, with industry heavyweights lauding the decision as likely to aid crypto exchanges Coinbase and Binance in their respective lawsuits.

Luke Martin, the founder of crypto investment firm Venture Coinist noted that the “core component” of the United States Securities and Exchange Commission's (SEC) claim in its suits against Binance and Coinbase is that they offered the sale of unregistered securities on their platforms.

After losing on this matter in the case of XRP, Martin believes this will serve as a substantial blow to the SEC and its chair, Gary Gensler.

Ripple (XRP) has now become the fourth largest cryptocurrency by market capitalization after Ripple Labs’ partial victory over the Securities and Exchange Commission (SEC) on July 13. 

Mere hours after the ruling, XRP market cap surged a whopping $21.2 billion to reach a new yearly high of $46.1 billion, pushing it up from the 7th position to beat out Circle’s USD Coin (USDC) and Binance’s BNB (BNB) token in the process.

At the time of writing, Ripple’s market capitalization has settled down to $42.5 billion.

The sudden surge for XRP came immediately after the District Court for the Southern District of New York declared that the “offer and sale of XRP on digital asset exchanges did not amount to offers and sales of investment contracts” in a case involving Ripple Labs and the SEC.

Experts want to give AI human ‘souls’ so they don’t kill us all

Until now, it’s been assumed that giving artificial intelligence emotions — allowing them to get angry or make mistakes — is a terrible idea. But what if the solution to keeping robots aligned with human values is to make them more human, with all our flaws and compassion?

That’s the premise of a forthcoming book called Robot Souls: Programming in Humanity, by Eve Poole, an academic at the Hult International Business School. She argues that in our bid to make artificial intelligence perfect, we have stripped out all the “junk code” that makes us human, including emotions, free will, the ability to make mistakes, to see meaning in the world and cope with uncertainty. 

“It is actually this ‘junk’ code that makes us human and promotes the kind of reciprocal altruism that keeps humanity alive and thriving,” Poole writes.

“If we can decipher that code, the part that makes us all want to survive and thrive together as a species, we can share it with the machines. Giving them, to all intents and purposes, a ‘soul.’”

Of course, the concept of the “soul” is religious and not scientific, so for the purpose of this article, let’s just take it as a metaphor for endowing AI with more human-like properties.

If good UX is like driving auto, Web3 is ‘driving stick’ — UX designers

The current state of Web3 user experience is akin to driving a manual transmission car — there’s more control, but most users will find it unnecessarily clunky, according to several UX designers.

Over the years, discussion around mainstream adoption of Web3 has centered around the need to improve crypto’s user experience and “ease of use.”

However, in a July 12 Twitter post, Web3 UI/UX designer “0xDesigner” argued that certain properties of blockchain make it challenging to build easy-to-use Web2-like applications.

According to 0XDesigner, the one of the main issues with cryptocurrency applications is that every action is “irreversible” — there’s no “undo button” on the blockchain and mistakes are expensive. They added:

“Think of it this way: Web2 is like driving an automatic car. It's straightforward; you get in, press the pedal, and off you go. Web3, on the other hand, is more like driving stick.

BNB Beacon Chain hard fork adds 'panic' feature that can 'halt' blockchain

The Binance-operated BNB Beacon Chain mainnet is set to add a new feature in its upcoming hard fork, which will give the blockchain the ability to “halt” the production of new blocks if certain conditions are met.

In a July 12 statement from BNB Chain, the “ZhangHeng” upgrade is expected to take place at block height 328,088,888, which it expects will occur on July 19.

The hard fork will introduce Binance Evolution Proposal BEP-255, which seeks to implement "on-chain asset reconciliation" — which Binance believes could mitigate damage from potential cross-chain bridge exploits such as the Binance Smart Chain exploit on Oct. 7, 2022. 

"Although some enhancements have been made to improve cross-chain security, such as BEP171, the security of assets on the BNB Beacon Chain itself should also be guaranteed, especially after the bridge exploitation," according to the Github post concerning BEP-255. 

Binance explained that under the BEP, user balance changes will be tracked in each block and will be reconciled to identify any issues.

BNB’s soaring futures open interest and regulatory woes weigh on the altcoin’s price

The price of BNB token has experienced a 24.5% decline over the past 90 days, despite a 7% gain between July 10 and July 11. BNB has performed worse than the overall altcoin market, indicating that the underlying cause for the bearish momentum persists.

It is highly likely that the correction in BNB's price can be attributed to the lawsuit filed by the U.S. Securities and Exchange Commission (SEC) against Binance exchange and its CEO Changpeng "CZ" Zhao on June 5, as the decoupling coincides with that event.

Is the recent BNB price rally sustainable?
